1 a Early Edition B4 THE COURIER- JOURNAL, FRIDAY, DECEMBER 4, 1992 Jefferson starts making payments to settle suits over jail strip searches By DEBORAH YETTER Staff Writer Jefferson County government has begun making payments to people to settle allegations they were illegally strip-searched at the jail, in a development that shows the controversial searches may indeed prove extremely costly to the county. So far, the county has paid or agreed to pay $235,000 to 12 of the more than 25 people who sued the jail, claiming that they were forced to remove all or most of their clothing following their arrests for a variety of minor offenses. Recent individual payments or agreements on payment have ranged from $7,500 to $27,500, First Assistant County Attorney N. Scott Lilly said yesterday. And the most costly cases may lie ahead, according to lawyers who spoke at a settlement conference yesterday in U.S.

District Court in Louisville before Judge Edward H. Johnstone. 'Lawyer Gregory A. Bolzle, a lead attorney in the case, said some of his clients are holding out for $60,000 and are prepared to go to trial if necessary. "Those cases will outrage the jury," he said.

Plaintiffs include a grandmother arrested and strip-searched after i inadvertently missing a court date for a traffic citation, a minister dressed in a tuxedo on his way from a dinner party stopped for driving with his lights off, and a father with two children in the car mistakenly arrested because he had the same name as a suspect police were Depending Bolzle said. on circumindividual stances of their clients, some attorneys are asking for higher amounts. "I don't believe these are unreasonable demands at all," Bolzle said. Some clients have agreed to settle their claims for $30,000 but the county so far has refused to pay that amount, Bolzle said at the settlement conference. Lilly wouldn't comment on any specific offers the county has made or rejected, objecting to a reporter's presence at the conference.

"I don't think it's fair to conduct settlement negotiations in the newspaper," he said. Johnstone urged the lawyers to continue to negotiate privately and to report back to him if any more settlement agreements are reached. Even if all plaintiffs were paid only $19,500 the average of the $235,000 agreed on to settle 12 cases it would cost the county around $500,000. The payments could pose a financial hardship, said Larry Smith, spokesman for Jefferson County Judge-Executive David Armstrong. The money comes from the county's general fund and "we will have to cut someplace else to make those payments," Smith said.

An additional cost to the county was $5,000 Johnstone recently ordered the county to pay to the plaintiffs' lawyers as a sanction for filing a frivolous motion in the case. Jail officials have defended strip searches for weapons and contraband as necessary to ensure security, but in June of last year they stopped routine searches of people arrested for minor offenses. The strip searches currently at issue occurred after the U.S. 6th Circuit Court of Appeals ruled in 1988 that the county could not stripsearch people detained for minor offenses without a reasonable suspicion that they might be carrying weapons or drugs. That case arose from a lawsuit filed by a Pleasure Ridge Park woman who claimed she was illegally strip-searched after her arrest for failing to appear in court over a traffic offense even though she had been given the wrong date by a Jefferson District Court employee.

The county paid $30,000 to her and $25,000 to her lawyer, Bolzle, to settle the case but continued the strip searches, claiming the 6th Circuit ruling was merely The county relied on that defense when it responded to the series of lawsuits that began in February 1991 after Steven W. Price, a salesman, was stopped for speeding and arrested for failing to list his current address on his driver's license. Price claimed he was illegally stripsearched at the jail; the number of people who filed suit after him grew to more than 25. The county's defense that the federal appeals court ruling was merely advisory was rejected in a stinging rebuke by a federal judge who found that the 6th Circuit ruling clearly applies. He ruled that the county's motion to dimiss the cases was frivolous; the county was ordered by Johnstone to pay $5,000 to the plaintiffs' lawyers as a sanction.

In an interview yesterday, Lilly wouldn't comment on whether it was wise for jail officials to continue the strip searches after the 1988 federal court ruling because many of the cases are not settled and may go to trial. MADISONVILLE Lillie Mai Boston council overrides condom machine veto BOSTON (AP) The city council overrode the mayor's veto of an AIDS-prevention ordinance that would require bars and restaurants to install condom-vending machines. The council voted 9-3 in favor of the ordinance, which applies to businesses that serve alcohol, have an entertainment license and can seat more than 100 people. "What it tries to do is warn people while they're most vulnerable, while they're drinking and dating, that there is this epidemic going on," said Councilor David Scondras, the measure's sponsor.

Mayor Raymond Flynn declined to comment on the override. While many people fear becoming ill while traveling overseas, Gueorogui Alexeev was thankful when he got sick while he was away from home.

Alexeev, a Russian musician, became critically ill over the weekend while performing in South Bend. Doctors found a bleeding ulcer that had drained almost two-thirds of Alexeev's blood before he received treatment Sunday. Although his condition was grave, it might have been worse had he fallen ill at home in St. Petersburg, where crucial medical supplies and even food are scarce, he said. "There's a big problem," he said Wednesday from his hospital bed at St.

Joseph's Medical Center. "The government does not have enough money." Alexeev, 28, is touring the United States this month with 13 other members of a Pentecostal church. The group is trying to raise money and other support for construction of a larger church building. Religion has flourished in postcommunist Russian, said Alexeev. It has been one stable element people could rely on in a time of political, economic and social uncertainty, he said.

He's glad for the religious freedom the social upheaval has fostered. "I believe in God; I believe in the Bible," he said through an interpreter, Charles Ruf*cku, a St. Joseph's medical technician who studied in Russia. Alexeev's group performed at the Christian Tabernacle in South Bend over the weekend, then continued on to churches in Texas and Oregon, leaving Alexeev behind. Alexeev planned to recuperate at a home in Granger before meeting up with the group for a flight home Dec.

Arrangements: Mountain View Mortuary, Altadena. A. Gardner Fox, a retired physicist and inventor who made discoveries in radar, microwave communications and lasers, died Nov. 24 at the Evergreen nursing home in Harmony, Pa. He was 80.

His family reported his death Wednesday and said the cause was Alzheimer's disease. Fox worked at Bell Telephone Laboratories for 41 years and held 53 patents in the microwave and quantum electronics fields. His research has been used in a wide range of fields, from weaponry to overseas telephone calls to airplane communications. Fox and Dr. Tingye Li developed the basic theory of light behavior in laser beams, opening the way to the construction of laser devices.

Born in Syracuse, Fox grew up there and in Montclair, N. J. He earned his bachelor's degree and a master's in electrical engineering from the Massachusetts Institute of Technology. The funeral for Donald Scott "Scotty" Baker, the slain ClayCounty 10-year-old whose burned body was found Tuesday in Laurel County, will be at 2 p.m.

tomorrow at Britton Funeral Home in Manchester. The burial will be in Manchester Memorial Gardens, and visitation will be after 6 p.m. today. Scotty was abducted the day before Thanksgiving from Paces Creek Elementary School in Manchester. His stepmother, Stephanie Genean Baker, and a friend of hers, Susanne Renee Baker, both 22, have been charged with murder in connection with his death.

Scotty, of Garrard, was a fifthgrader at Paces Creek. His survivors include his father, Donnie Lee Baker of Garrard; his mother, Ruth Baker of Bush; a brother, Jeremy Vega of Senoia, two sisters, Tonya Burns and Amy Burns, both of Bush; his grandparents, Alonzo and Dorothy Jackson of Garrard and Juanita Miller of Corbin; and his greatgrandparents, Hobert Jones of London and Annie Smith of Garrard.
