Oversizing the Tension Between Justice and Peace? Reflections on Transitional, Criminal and Restorative Justice in Colombia

It is commonly said that there is an irreducible tension between justice and peace in the transitional justice processes in the context of a political negotiation aimed at the cease of an internal armed conflict. However, there is an underlying paradigm of justice in this vision, strongly inclined towards retribution, braced in the international duty to investigate, judge, and penalize those responsible for grave violations to human rights. Still, in settings of transitional law, such as the case at hand, in addition to the legitimation problems of criminal justice -which are even greater than those found in “ordinary” contexts the international duty is not absolute. Instead, it leaves a wide margin for granting conditional amnesty and pardon, and to impose alternative sentences. This allows for the prevailing adoption of a restorative justice paradigm for this kind of transitional justice processes, which allows to considerably reduce the existing tension between justice and peace ...

Metacontingency Analysis of the Justice and Peace Law in Colombia

"Within the perspective of behaviour Analysis, there is a young, but fruitful, tradition of study and intervention on Cultural Practices. This tradition has startted, amongst others, the concept of Metacontingency which is a functional relationship between the interlocked individual behavioural contingencies and a certain aggregate product, which at the same time, operates on the third (cultural) level of selection. As in contingency that works on the second level of selection, it is important to be specific with contingency terms in order to increase the influence on behaviour. On this research “Justice and Peace Law in Colombia” was analysed to search specifications mentioned previously; this analysis shows that the way the law is written is not properly in accordance with the principles of contingency specification. Suggestions are offered to continue working in this direction."

There is generally a gap between constitutional law and social practice, and in Colombia, there are peculiarities despite similarities and common elements with other Latin American countries. Colombia has experienced an internal armed conflict since the mid-sixties, but like other countries in the region, lacks strong State institutions. There is a coexistence between formal civilian and democratic tradition with a tendency in practice to violate norms, rules and rights. In the early nineties, several internal and external factors were crystallized, which led to a new constitution (1991) with a mission to form a peace process. This work is framed in a political science and sociology discussion on the performative capacity of the law, based on the concept of rule of law and its relation to the institutional weaknesses (Barros 2003; Levitsky and Murillo 2009). El presente artículo de reflexión que se titula " El juego de intereses de los actores políticos para el diseño de la justicia transicional en Colombia " , se Resumen El presente artículo de reflexión describe el proceso de formulación de políticas públicas con miras al proceso de paz en Colombia donde participan actores estatales y no estatales. Así entonces, inciden en el diseño de mode-los de justicia transicional actores como las Fuerzas Militares, los gremios económicos, los medios de comunicaciones y las ONG. En dicha discusión y debate se encuentran intereses paralelos, comunes y opuestos lo que denota la complejidad del proceso de construcción de modelos de transición que fa-ciliten la consecución de la paz y la reparación de las víctimas como aspecto fundamental para la reconciliación nacional. A partir de lo anterior, el presente artículo parte de la comprensión del comportamiento de Colombia como Es-tado y como gobierno frente al conflicto armado, esbozando las tensiones que se han producido por las ambivalencias frente a este y la imposibilidad del cumplimiento de los estándares internacionales de DDHH. Seguidamente se abordan los instrumentos de justicia transicional implementados en Colombia en contraste con los estándares internacionales para la justicia transicional. Finalmente, se interpreta las posiciones y el juego político de los actores es-tatales y no estatales para el proceso de formación de los modelos de justicia transicional. Abstract The present article of reflection describes the process of formulation of public policies with a view to the process of peace in Colombia where state actors take part and not state. This way then, there affect in the model design of transitional justice actors like the Military Forces, the economic unions, the means of communications and the NGOs. In the above mentioned discussion and debate they find parallel, common and opposite interests what denotes the complexity of the process of model construction of transition that there facilitate the attainment of the peace and the repair of the victims as fundamental aspect for the national reconciliation. From the previous thing, the present article departs from the comprehension of the behavior of Colombia as State and as government opposite to the armed conflict, outlining the tensions that have tak-en place for the ambivalencias opposite to the same one and the impossibility of the fulfillment of DDHH's international standards. Immediately afterwards there are approached the instruments of transitional justice implemented in Colombia in contrast by the international standards for the transitional justice. Finally, is interpreted the positions and the political game of the state and not state actors for the process of formation of the models of transitional justice.
